Punishment And Salvation: The Penalty As A Salvific Tool In Augustine Of Hippo

Abstract
The article analyzes Augustine’s philosophical proposals on freedom and their relationship with criminal attribution, investigating the necessary elements for criminal responsibility and the role of both human and divine law in determining punishment. It questions whether punishment seeks the salvation of the offender’s soul, extending this purpose to the present day and reflecting on the constitutional assessment of punishment in current law. To this end, Augustine’s works, especially On Free Choice of the Will and City of God, are examined, exploring the connections between punishment and salvation through the Foucauldian method and the idea of Pastoral Power. The analysis includes technologies and power devices, highlighting the functions of the penal apparatus, allowing an exploration of how truths are constructed to support criminal discourses in the social fabric.
